PointCraft Merchant Agreement Acceptance
By checking this box, you acknowledge that you have read and agree to the PointCraft Merchant Agreement (“Agreement”) and agree to be legally bound by its terms.
This Agreement governs your use of the PointCraft payments platform, point-of-sale systems, software, hardware, and related services.
1. Use of Services
PointCraft provides payment processing and commerce services that allow businesses to accept payments for goods and services. By using these services, the Merchant agrees to comply with all applicable laws, regulations, card network rules, and payment processor requirements.
The Merchant agrees to only sell legal goods and services and to avoid any fraudulent, deceptive, or prohibited transactions.
2. Transactions
PointCraft facilitates payment transactions between the Merchant and its customers. The Merchant remains responsible for all goods and services sold and for resolving any customer disputes related to those transactions.
3. Fees
The Merchant agrees to pay applicable fees associated with the use of the platform, which may include:

Transaction processing fees

Chargeback or dispute fees

Monthly service or subscription fees

Equipment or terminal fees
-
Optional service fees (such as online ordering or additional integrations)
Fees may be deducted directly from processed payments or from the Merchant’s designated bank account.
4. Chargebacks and Refunds
The Merchant acknowledges that customer disputes and chargebacks may occur. The Merchant is responsible for responding to chargebacks and may be charged a chargeback fee.
Processing fees associated with completed transactions may not be refunded in the event of refunds or reversals.
5. Compliance and Risk Monitoring
PointCraft may monitor transactions for fraud, risk, and compliance purposes. The Merchant agrees to cooperate with any requests related to fraud prevention, underwriting, or regulatory compliance.
Accounts may be suspended or terminated if activity violates laws, card network rules, or processor requirements.
6. Limitation of Liability
To the maximum extent permitted by law, PointCraft shall not be liable for indirect, incidental, or consequential damages arising from the use of its services.
7. Termination
Either party may terminate services in accordance with the applicable service terms. Upon termination, the Merchant remains responsible for any outstanding fees or obligations.
8. Confidentiality
Both parties agree to keep confidential any non-public business or technical information shared in connection with the services.
9. Governing Law
This Agreement is governed by the laws of the State of Minnesota.
Merchant Acknowledgment
By continuing registration, you confirm that:

You are authorized to act on behalf of your business.

You agree to the PointCraft Merchant Agreement and applicable service terms.

You acknowledge that this acceptance constitutes a legally binding agreement.
