Master Services Agreement Acceptance
By checking this box, I acknowledge that I have read and agree to the PointCraft Master Services Agreement (“Agreement”) and agree to be bound by its terms.
This Agreement governs the use of services provided by PointCraft Inc., including but not limited to payment processing, point-of-sale systems, software, hardware, and related support services.
By accepting this Agreement, the business registering (“Client”) agrees to the following:
1. Services
PointCraft may provide payment processing, point-of-sale systems, software applications, hardware equipment, and related services (collectively, the “Services”). The Client agrees to use these services in accordance with all applicable laws, regulations, and the terms of this Agreement.
2. Equipment and Software
Any equipment, software, or devices provided by PointCraft remain the property of PointCraft unless otherwise agreed in writing. The Client agrees to use such equipment and software only for authorized business purposes and to return equipment upon termination if required.
3. Fees and Payments
The Client agrees to pay all applicable fees for services, including subscription fees, equipment fees, transaction processing fees, and any other charges agreed upon during onboarding or through future service orders.
4. Compliance and Lawful Use
The Client agrees to conduct only lawful business activities and to comply with all applicable laws, card network rules, and payment processor requirements. Fraudulent, illegal, or prohibited transactions are strictly prohibited.
5. Confidentiality
Both parties agree to maintain the confidentiality of non-public business, technical, or financial information shared in connection with the services.
6. Data and Security
PointCraft may store, process, and analyze operational or transaction data necessary to provide services and improve the platform. Reasonable security measures will be maintained to protect sensitive information.
7. Limitation of Liability
To the maximum extent permitted by law, PointCraft shall not be liable for indirect, incidental, or consequential damages arising from the use of its services.
8. Termination
Either party may terminate services in accordance with the terms of the Master Services Agreement. Upon termination, the Client remains responsible for any outstanding fees and the return of company-owned equipment.
9. Governing Law
This Agreement is governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.
Acknowledgment
By reviewing this and continuing registration, I confirm that:
I am authorized to act on behalf of the registering business.
I agree to the PointCraft Master Services Agreement and Terms of Service.
I acknowledge that this acceptance constitutes a legally binding agreement.
